Composition of Ghana FA’s New REFEREES Committee is inconsistent with FIFA Regulations on Refereeing and Ghana FA Statutes
When the Ghana FA made their first referees committee Appointment in 2019, I point out to them the inconsistency in the composition of the membership, relative to the Statutes of the Association, and the REGULATIONS on the Organisation of Refereeing in FIFA Member Associations, the FA turned a ‘blind eye’ to my Petition for them to reconstitute the committee, Fast forward to 2020, FIFA again modifies the Regulations on the composition of the membership of the committee, Ghana FA then reconstitutes the committee, buy yet again included in the list, persons who do not ‘qualify’ to be on the committee.
In reconstituting the new Referees committee, the Ghana FA has ‘failed’ to acknowledge two critical constitutional provisions in their own statutes, and the new REGULATIONS on the Organisation of Refereeing in FIFA Member Associations, Making the Committee non constitutional, and therefore any Appointments, recommendations, actions and inactions of the referees committee shall be deem to be null and void.
1. Article 50  of the GFA statutes 2019 is inconsistent with section 4 of the REGULATIONS on the Organisation of Refereeing in FIFA Member Associations.
2. Unqualified members of the committee
Article 50 of the Ghana FA statutes mandates the chairman of the Referees committee to occupy a seat on the executive council of the Football Association, [The Referees Committee shall be made up of five (5) Members headed by a Chairman who must be a member of the Executive Council. The Vice Chairman and the other Independent members of the Committee consisting of one (1)woman, two(2) retired FIFA Referees and one independent member to be appointed by the Executive Council. The Independent members shall not be affiliated with any football Club or Football Association. The Referees Committee shall implement the Laws of the Game and shall appoint the
referees for matches in competitions organised or sanctioned by the GFA.]
1.The above provision is inconsistent with the New REGULATIONS on the Organisation of Refereeing in FIFA Member Associations, which states that the Chairman of the committee shall be former Referee.
With no former Referee on the Executive council of the Ghana FA, the Football Association reconstitutes the committee without first ammending the provisions of the Statutes, this is a clear violation of the Statutes. The provisions of article 78 is not enough to clear this ‘mischief’ from the FA.
2. The Ghana FA has also included in the list of members of the committee two persons who do not meet the requirements of the ‘REGULATIONS on the Organisation of Refereeing in FIFA Member Associations’.
The regulation is clear and explicit on the composition and qualification of members, it states as follows
A. Must be composed of ONLY former Match officials
B. Must not be affiliated with any club
C. Must not belong to any league
D. Must not belong to any other Football organization
E. Must not belong to any other referee organisation [Union, membership group]
This provisions has been breached once again by the FA with the inclusion of 2 persons who have never been match officials before.
The committee has a member who is affiliated to a Football club, and a sitting chairman of another Football organisation, in clear violation of the REGULATIONS on the Organisation of Refereeing in FIFA Member Associations.
The executive council of the Ghana FA must take steps to quickly withdraw those members on the referees committee to conform with the REGULATIONS on the Organisation of Refereeing in FIFA Member Associations, while working to amend article 50 of the Ghana FA Statutes.
As a regulatory body responsible for the administration of Football in Ghana, the FA must be the first to respect the provisions of their own statutes, and that of FIFA, CAF, and WAFU.
an unconstitutionally composed referees committee may not have the mandate of the members of the Association to adminster the provisions of the statutes, and could lead to confusion with the Football setup of Ghana.
It is my humble appeal that the leadership of the GFA should as a matter of urgency call an emergency Congress to amend the provisions of Article 50 to conform with the REGULATIONS on the Organisation of Refereeing in FIFA Member Associations.
